Aquarium plants in Australia: what's legal and what isn't

Australian planted-tank keepers work under tighter rules than almost anywhere else, and most people discover this only when an online order is seized at the border or refused entry to their state. The restrictions are not arbitrary: several of the worst weeds in Australian waterways arrived as aquarium plants and escaped. This guide covers what you cannot import, which species are banned outright, why Western Australia is a separate problem, and how to buy and dispose of plants without breaking the law.

Why you cannot import aquarium plants

Live plants can only be imported into Australia under an import permit issued by the Department of Agriculture, Fisheries and Forestry (DAFF). The single exception is orchid tissue culture carried as accompanied baggage, which is no help to anyone setting up an aquarium. There is no separate, easier pathway for hobbyists. The permit system exists for commercial nursery stock moving through inspection and post-entry quarantine, and the cost and paperwork put it far outside what an individual would attempt for a few stems of Rotala.

The practical result is simple. If a website offers to post aquarium plants to Australia from overseas, either the order will be intercepted and destroyed at the border, or the seller is mislabelling the parcel, which makes the buyer the one importing prohibited material. Neither outcome is worth the saving.

Import conditions for any specific plant can be checked in BICON, the Biosecurity Import Conditions system, which holds the conditions for more than 20,000 plants, animals and biological products. It is worth knowing BICON exists even if you never use it, because it settles arguments about what is and is not allowed.

This is also the reason Australian plant prices look high. Every plant in every Australian shop was grown here, mostly by a small number of domestic nurseries and tissue culture labs. The supply chain is short, the volumes are modest, and there is no overseas competition to push prices down. It is a closed market by law rather than by choice.

The five aquatic plants banned nationally

Thirty-two plants carry the status of Weed of National Significance, agreed by Australian governments on the basis of invasiveness, potential spread, and environmental and economic impact. The original list of 20 was endorsed in 1999 and expanded to 32 in April 2012. Five of them are aquatic or semi-aquatic, and every one of them entered Australian waterways through the aquarium and pond trade.

Cabomba is the one that catches aquarium keepers most often, because it looks like an ordinary fine-leaved stem plant and closely resembles species that are perfectly legal. If you are offered cabomba, or something described loosely as "cabomba-like oxygen weed" at a market or through a hobbyist swap, decline it. Possessing and moving a Weed of National Significance carries real penalties, and the specific offences and permit conditions are set by each state rather than nationally.

National listing describes the weed's significance rather than creating the offence. The offence, the penalty, and any permit conditions are made by state and territory legislation, which is why the same plant can be handled quite differently in New South Wales and Victoria.

State rules and why they differ

Beyond the five national listings, each state and territory maintains its own declarations of prohibited and restricted plants, made under its own biosecurity legislation. A plant can be sold openly in one state and be a notifiable pest in the next, which is genuinely confusing and is the reason blanket advice about "banned aquarium plants in Australia" is usually wrong.

Several species common in the international hobby sit in this awkward middle ground, including Egeria densa (dense waterweed), Elodea canadensis, Hygrophila polysperma, Myriophyllum aquaticum (parrot's feather) and Hydrilla verticillata. Rather than list their status here, where it would go stale, check your own state's declared pest register before buying any of them. Weed declarations are reviewed and changed regularly, and a list printed in a guide is out of date the moment a state amends it.

Western Australia is a separate problem

Western Australia does not work like the other states, and this catches out both buyers and sellers. Under the Biosecurity and Agriculture Management Act 2007, the Western Australian Organism List (WAOL) sets the legal status of organisms as either permitted or declared pests. For plants and plant products to enter WA they must be listed as permitted on the WAOL.

The critical detail is the default. If a plant does not appear on the WAOL at all, its status is prohibited, not "unlisted" or "allowed until reviewed". You cannot send it into WA unless the Department of Primary Industries and Regional Development has explicitly added it to the permitted list. This inverts the assumption most people make, which is that anything not banned must be fine.

There are additional conditions on top of the permitted list. Aquatic consignments entering WA must be free of aquatic snails and of any plant not permitted under the WAOL, and permitted water plants may carry further entry requirements such as treatment or plant health certification from the sending state. For WA keepers, the practical answer is usually to buy locally rather than to fight the paperwork.

Buying plants in Australia

Because the market is closed to imports, Australian keepers buy in three formats, and the differences matter more here than overseas.

Tissue culture

Plants grown sterile in a sealed cup of nutrient gel. They arrive free of snails, algae, pest eggs and residual pesticide, which makes them the safest option by a wide margin and the only one that is genuinely risk-free for a shrimp tank. They are small, they need a transition period as they convert from emersed to submerged growth, and they cost more per plant. For a new tank, or any tank containing shrimp, the premium is usually worth paying.

Potted

Grown emersed in rock wool in a mesh pot. Good value and generally healthy, but the rock wool must be teased out completely before planting, and the plant will drop some or all of its emersed leaves as it converts to underwater growth. New keepers routinely think a potted plant is dying when it is only converting.

Bunched

Stems held together with a lead or rubber band. The cheapest option and the highest risk: bunched plants come from open grow-out systems and are the most likely to carry snails, planaria and algae. Remove the band immediately, since stems crushed under it will rot.

What comes in with the plants

Every plant format except tissue culture can introduce something you did not order. Bladder and ramshorn snails are the usual arrivals, along with planaria, hydra, and algae species that are much easier to add than to remove. None of these are dangerous to fish, but a snail population that establishes on the back of one bunch of Vallisneria takes months to bring back under control. Prevention is easier. Inspect the undersides of leaves for small translucent jelly clumps, which are snail eggs, and rinse everything thoroughly under running water before it goes in. Some keepers dip new plants in a dilute bleach or alum solution, which works but will kill delicate species and is easy to get wrong. For most people, tissue culture for the sensitive tanks and careful inspection everywhere else is the better trade.

Getting rid of plants legally

This is the part of plant keeping with the clearest environmental consequence, and the one most people never think about. Trimmings from a healthy planted tank represent viable, fast-growing aquatic plant material, and several of the worst weeds in Australia established from exactly this kind of casual disposal.

Never put aquarium plants or plant water into a creek, river, dam, stormwater drain, or gutter. Stormwater is not treated and runs directly into natural waterways. Do not put them in a green waste or compost bin either, since green waste is processed into mulch that is distributed widely and some aquatic species regenerate from fragments.

The correct method is unglamorous: bag the trimmings, leave the bag in the sun for a few days until the material is completely dry and dead, then put it in general waste. If you have surplus healthy plants, give them to another keeper or a local aquarium society instead, which keeps them in closed systems where they belong.

Australian native aquarium plants

Native species are worth considering, and not only on principle. They are adapted to the water chemistry that comes out of Australian taps, they are legal to keep and move within their home state, and several are genuinely attractive aquarium plants that happen to be under-used because the hobby's reference material is written overseas.

Useful natives include several Vallisneria species, which grow vigorously in the alkaline, mineral-rich water of Brisbane and the Perth limestone corridor, and a number of native Myriophyllum and Blyxa species. One caution applies in reverse. A plant being native to Australia does not make it legal everywhere in Australia. Species native to one catchment can be declared pests in another state, and the movement rules apply to natives exactly as they do to anything else. Check before you post plants across a border in either direction.
